Manitoba Metis Federation Files Court Challenge on Hydro Agreement

Winnipeg, MB – At a press conference held this morning at Manitoba Metis Federation (MMF) headquarters, President David Chartrand and MMF legal counsel detailed the judicial review filed today with the Manitoba Court of Queen’s Bench. The MMF’s court action seeks to overturn a decision the Manitoba Government made on March 21, 2018—following the unprecedented mass resignation of nine members of the Manitoba Hydro Board of Directors—directing Manitoba Hydro “to not proceed with the agreement with the Manitoba Metis Federation.”

The MMF claim argues that through this directive, the Manitoba Government, Premier Brian Pallister and Minister of Crown Services Cliff Cullen breached the honour of the Crown as well as other legal and constitutional duties owing to the MMF, flowing from the 2014 Turning the Page Agreement signed between the MMF, the Manitoba Government and Manitoba Hydro. The legal filing also seeks a declaration from court that the Premier breached the honour of the Crown in calling the MMF a “special interest group” and the MMF’s agreement with Manitoba Hydro “persuasion money.”

“These sorts of actions are fundamentally inconsistent with what we are supposed to be doing in the age of reconciliation,” noted prominent Metis lawyer Jason Madden at the press conference. “We’re going to be calling out Premier Pallister on that.”

“We will hold this government and Pallister to the very essence of their statements and their actions in court,” said President Chartrand.  “If you push our people, you try to disrespect our people, you try to exclude our people, you try to punish our people, the Metis Nation will come at you with everything that we’ve got. And today, my friends, we are coming, and we’ll be coming strong.”
