MMF Encouraged by National Energy Board Decision to Refuse Manitoba Hydro’s Request to Strike MMF-Hydro Agreement in Manitoba-Minnesota Transmission Line Hearings

Winnipeg, MB – Today, the National Energy Board (“NEB”) rejected Manitoba Hydro’s attempt to strike the July 2017 MMF-Hydro Agreement as evidence in the ongoing hearings about whether Canada will issue a certificate for the Manitoba-Minnesota Transmission Line (the “MMTP”).

“We are pleased that the NEB rejected Manitoba Hydro’s attempt to exclude our agreement with Manitoba Hydro from the evidence before the Board,” said MMF President David Chartrand.

The MMF’s legal counsel argued that it was necessary to have the July 2017 Agreement before the NEB because it was linked to the Board’s mandate and requirement to assess whether the Crown’s duty to consult and accommodate the Manitoba Métis Community had been met prior to the issuance of any certificate for the MMTP.

The MMF made it clear in today’s hearing that continues to be supportive of the MMTP, but this support and the successful discharge of the Crown’s duty to consult and accommodate owing to the Manitoba Métis Community is conditional on the MMF’s agreement with Manitoba Hydro being honoured.

“The MMTP should not be delayed because of Premier Pallister’s mistakes and the Manitoba Government’s unconstitutional actions that attempted to cancel our agreement with Manitoba Hydro, however, that is where this is leading if common sense doesn't prevail.  Since the Pallister Government won’t uphold the honour the Crown, we believe the NEB and the federal government must.”
