President Chartrand pays tribute to Métis rights champion and friend, Justice Tom Berger

Winnipeg, MB, in the Homeland of the Métis Nation - On behalf of the Manitoba Metis Federation (MMF) Cabinet, Citizens, and staff, President David Chartrand issued the following statement paying tribute to Tom Berger, who died at the age of 88 following a battle against cancer.

Today, the Métis people have lost a true friend and ally.

Tom Berger represented the Manitoba Metis Federation in our groundbreaking land-claim case. The case stemmed from Manitoba's entry into Confederation in 1870, when Canada agreed to deliver 1.4 million acres of land to Métis children in Manitoba. The case concluded in the 2013 Supreme Court decision that Canada's government of the day did not act in good faith with respect to Métis people and stated that "the unfinished business of reconciliation of the Métis people with Canadian sovereignty is a matter of national and constitutional import."

This decision fundamentally changed the course of law in Canada and the MMF case victory has been subsequently cited in numerous cases.

What we have been able to accomplish for our Nation in the years following these critical decisions simply would not have been possible without Tom Berger. The legacy he leaves for our Nation comes from his strong conviction that Canada's democratic institutions should support and uphold the rights of Indigenous people. Personally, I will never forget his comments after our second defeat on the MMF's Land Claim at Manitoba's Court of Appeal: Tom looked at me and said, "We've got them now, just where we want them." From there, we moved on to the Supreme Court of Canada and to victory.

Members of the MMF executive team and I had the privilege of meeting with him just days before his passing, to honour him and express the thanks of our grateful Nation for his contributions.

Tom Berger - champion, ally, and friend - will be deeply missed, but always remembered by the Métis people of Manitoba.

Winnipeg (Manitoba), dans la patrie de la Nation métisse - Au nom du Cabinet, des citoyens et du personnel de la Fédération Métisse du Manitoba (FMM), le président David Chartrand a fait la déclaration suivante en hommage à Tom Berger, décédé à l'âge de 88 ans à la suite d'une lutte contre le cancer.

Aujourd'hui, le peuple métis a perdu un véritable ami et allié.

Tom Berger a représenté la Fédération Métisse du Manitoba dans notre cause déterminante concernant les revendications territoriales. L'affaire découle d'un accord à la base de l'entrée du Manitoba dans la Confédération en 1870, lorsque le Canada a accepté de réserver 1,4 million d'acres de terre pour les enfants des Métis du Manitoba. L'affaire s'est conclue par la décision de la Cour suprême rendue en 2013 selon laquelle le gouvernement canadien de l'époque n'avait pas agi de bonne foi en ce qui concerne le peuple métis et que « la tâche inachevée de réconciliation des Métis avec la souveraineté du Canada est une question d'importance nationale et constitutionnelle. »

Cette décision a fondamentalement fait évoluer le droit au Canada et la victoire dans l'affaire FMM a par la suite été citée dans de nombreux jugements de la Cour suprême.

Ce que nous avons pu accomplir pour notre Nation dans les années qui ont suivi ces décisions cruciales n'aurait tout simplement pas été possible sans Tom Berger. L'héritage qu'il laisse à notre Nation vient de sa ferme conviction que les institutions démocratiques du Canada doivent soutenir et défendre les droits des peuples autochtones. Personnellement, je n'oublierai jamais ses commentaires après notre deuxième défaite relative aux revendications territoriales de la FMM à la Cour d'appel du Manitoba. Tom me regarda et dit : « Maintenant, ils sont là où on les voulait ». De là, nous sommes passés à la Cour suprême du Canada et à la victoire.

Les membres de l'équipe de direction de la FMM et moi-même avons eu le privilège de le rencontrer quelques jours avant son décès, pour l'honorer et lui exprimer la reconnaissance et la gratitude de notre Nation pour ses contributions.

Tom Berger - champion, allié et ami - nous manquera beaucoup, mais sa mémoire restera gravée à jamais pour les Métis du Manitoba.
